Litigation
Mohrman & Schofield PC provides general litigation services and support for all clients. The firm’s lawyers have experience practicing before state and federal tribunals (and are thoroughly familiar with state and federal rules of procedure and rules of evidence). The courts we practice in include state justice, district, and appellate courts and federal district and appeals courts. We also appear before other quasi-judicial tribunals (administrative agencies and courts) and non-judicial bodies (commissions, municipalities, etc.) on behalf of our clients.
The firm’s lawyers have participated in hundreds of jury and non-jury trials, and although we are skilled advocates capable of taking matters to trial, we recommend and emphasize mediation. We have mediated and settled far more cases than we have taken to trial. Trial should be reserved for those cases where mediation was unsuccessful and settlement is otherwise not feasible. It is our philosophy that following fact gathering through appropriate discovery, and after analysis of the facts, the law, and the competing claims, mediation is the best next logical and cost-effective step. Mediation is almost always the most cost-effective way to resolve claims and it provides clients with the most control over outcomes in contested matters.
Our litigation services are primarily provided in the context of family law and juvenile law. However, we do have the capability and do provide legal support outside of those practice areas. We represent individuals and businesses involved in various contract and other commercial disputes, we represent a few select individuals in personal injury actions, we provide representation for individuals and businesses in claims not covered by insurance, exclusive of debt collection, and we represent public interest entities in environmental matters.
