Appeals

The appellate attorneys at Mohrman & Schofield practice all aspects of appellate law, in criminal and civil matters, before the Utah Court of Appeals, the Utah Supreme Court, and the United States Court of Appeals for the 10th Circuit. Our appellate attorneys will engage at any stage of the appellate process, from deciding whether to appeal, to drafting persuasive, well-researched briefs (including responding to an appeal initiated by the other party), to presenting oral argument.
 
The first and most critical step in the appeals process is evaluating whether to appeal. According to statistics presented by the Utah State Bar, only 5-7% of the decisions appealed to the Utah Supreme Court and the Utah Court of Appeals between 2007 – 2009 resulted in reversal.   Before filing a notice of appeal, we can evaluate your case to determine if there are reversible errors that can be successfully challenged on appeal.  There are important time limits for filing a notice of appeal, so it is important to consult a knowledgeable and experienced appellate attorney right away to protect your appellate rights.
